Contract transfer (off-plan)
Pass on your off-plan unit before completion
You bought a unit under construction and want to exit? This is how a contract transfer works – explained honestly.
How does a contract transfer work?
- 1Check your purchase contract (SPA): is a transfer allowed, from when and at what fee?
- 2Get the developer’s written consent – without it there is no transfer
- 3Find a buyer – we broker via X Market (listing is free)
- 4Sign a transfer agreement between you, the buyer and the developer
- 5The buyer takes over the remaining instalments directly with the developer
Where do the payments go?
Only to the developer – or exactly as the written transfer agreement says. Never to X Property: we only broker and never accept money, not even deposits.
Always confirm bank details directly with the developer by calling its official number. If the account name differs from the developer in your contract: do not pay.
Check a number or payment requestDeveloper consent & fee
Whether and at what cost a transfer is allowed is set out in your purchase contract and decided by the developer. We deliberately publish no fees here – they differ by project and contract. Ask the developer for the current conditions in writing.
Which documents?
- Purchase contract (SPA) with all annexes
- Reservation confirmation
- Receipts for all payments made to the developer
- FET proof for money transferred from abroad
- Passport copy
- Power of attorney, if someone signs for you
Foreign buyer: FET proof
For registration at the Land Office, a foreign buyer needs their own proof that the money came from abroad. Clarify with the developer and the bank how this works in a transfer.
Lawyer
Have the transfer agreement checked by a licensed lawyer in Thailand – you can verify the licence with the Lawyers Council of Thailand.
